A Strategic Motions Practice

In basic terms, a motion is a kind of request made before a judge during any stage of legal proceedings. For example, very often in unlawful detainer proceedings/evictions and other civil matter a party may not be properly or timely served, or for other reasons may not answer the complaint on time, and thus be defaulted by the other side. We have a great deal of experience in motions to set aside defaults and default judgments, which set aside motions must be done in order to get back into the case and defend the action. Other times our attorneys may believe that even if the opposing party's position were looked at in its best light, a decision would still be made in our client's favor, and we might move for summary judgment.

At Daggenhurst Zakari, our motions practice is broad and strategic. The types of motions we use include:

  • Motions for summary judgment
  • Motions for summary adjudication
  • Motions to dismiss
  • Motions to compel
  • Motions to set aside defaults
  • Motions to quash
  • Motions to strike
  • Motions for relief from forfeiture
  • Motions to reopen discovery proceedings
  • Motions to stay forfeiture
  • Motions for a new trial
  • Motions to re-consider
  • Attorney’s Fees Motions
  • Motions to Consolidate & Relate
  • Emergency Motions
  • Demurrer (Quasi Motion)

Our approach goes far beyond simply filing standard motions. We understand the California court system, and we know that in addition to content, presentation is a key element in obtaining a favorable decision. Our strategy lies in acting reasonably, diligently and ethically in court. If motions key to our clients’ cases are denied, we may use our appellate and writ know-how to pursue a review of the Court’s decision while preserving our clients' rights.

In addition to our motions practice, our attorneys handle appeals, and in fact often take appeals referred by other lawyers. To find out how we can help you in your tenancy case related to residential or commercial property, contact us today.
